Terms of service

OVERVIEW

Welcome to TAHHO. The terms "TAHHO," "we," "us," and "our" refer to [LEGAL BUSINESS NAME], trading as TAHHO.

TAHHO operates this website and online store, including all related information, content, features, tools, products and services (collectively, the "Services"). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies referenced herein, describe your rights and responsibilities when using the Services or purchasing from us.

By visiting, interacting with or using our Services, you agree to these Terms. If you do not agree to these Terms or our Privacy Policy, you should not use the Services.

Nothing in these Terms limits any consumer rights that cannot lawfully be excluded or restricted under applicable law.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your place of residence or otherwise legally capable of entering into a binding contract.

You may be asked to provide information including your email address, billing information, shipping information and payment details. You represent that all information you provide is accurate, current and complete.

You are responsible for maintaining the security of your account credentials and for activity occurring through your account.

SECTION 2 - OUR PRODUCTS

TAHHO creates handmade and made-to-order wallcoverings, wallpaper murals, metallic leaf wallcoverings, wall art and related products.

Because many of our products are handmade using processes such as hand-applied metallic leaf, hand-painting and other artisanal techniques, reasonable variations are inherent to the product.

Such variations may include differences in color, tone, texture, sheen, metallic reflection, patina, brushwork, placement of individual leaf pieces, hand-painted details and other characteristics arising naturally from handmade production.

These natural handmade variations are part of the character of the product and are not considered defects where the product otherwise materially conforms to the agreed specification.

We make reasonable efforts to display product colors, textures and finishes accurately. However, colors and appearance may vary depending on screen settings, lighting, photography, digital rendering, viewing angle, surrounding materials and other factors.

Metallic finishes in particular can appear substantially different depending on lighting conditions and viewing angle.

Samples are intended to help customers evaluate materials, finishes and general color direction. Because our products are handmade, a sample may not be identical in every detail to the finished order.

Products created in separate production batches may show slight variations. Where consistency across one installation is important, we strongly recommend ordering the full required quantity at the same time.

Product descriptions, photographs, visualizations and samples are intended to represent the product as accurately as reasonably possible but cannot reproduce every handmade characteristic of the finished item.

SECTION 3 - CUSTOMIZATION, MEASUREMENTS AND APPROVALS

Many TAHHO products may be made according to customer specifications, including dimensions, colors, composition, artwork placement, materials or finishes.

You are responsible for providing accurate measurements and specifications.

Where we assist with calculating quantities or dimensions based on information you provide, our assistance does not replace professional site measurement and does not constitute a guarantee that customer-provided measurements are correct.

Walls, ceilings and architectural surfaces may not be perfectly straight, square or level. Customers and their installers are responsible for considering appropriate tolerances and installation allowances.

For custom artwork, murals, compositions or color adjustments, we may provide a digital proof, rendering or other approval image before production.

Once you approve a proof or specification, that approved version becomes the basis for production.

Digital proofs are intended primarily to confirm composition, scale, placement and requested design changes. They are not guaranteed to reproduce exact physical colors, metallic reflection or material texture.

Changes requested after approval may result in additional charges and changes to the estimated production timeline. Once production has begun, some changes may no longer be possible.

SECTION 4 - ORDERS AND CANCELLATION

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline an order where permitted by law.

Your order is accepted once we confirm acceptance and payment has been successfully processed.

Please review your order carefully before submitting it.

Unless otherwise required by applicable law, an order may be cancelled within 24 hours after it is placed by contacting us promptly.

After this period, production may already have started and cancellation may no longer be possible.

Many TAHHO products are produced to a customer's specifications or are otherwise clearly personalized. Where applicable law provides an exception from statutory change-of-mind cancellation rights for such products, that exception will apply.

This does not affect your statutory rights if a product is defective, damaged, materially different from the agreed specification or otherwise non-conforming under applicable consumer law.

Returns, refunds and cancellations are governed in more detail by our Refund Policy.

SECTION 5 - INSPECTION AND INSTALLATION

Please inspect all products promptly after delivery and before cutting, trimming, applying adhesive or beginning installation.

Before installation, you or your installer should verify:

  • the product and design ordered;

  • dimensions and quantities;

  • panel or roll sequence where applicable;

  • visible color and finish consistency;

  • the absence of apparent transit damage or manufacturing defects.

If you believe there is a problem with your order, stop installation and contact us before proceeding.

Installation of wallpaper or wallcoverings involves conditions outside our control, including the wall substrate, moisture levels, surface preparation, adhesives, tools, room conditions and installer technique.

We strongly recommend using an experienced professional wallpaper installer, particularly for handmade, metallic leaf or large-format mural products.

TAHHO is not responsible, to the extent permitted by law, for damage, loss or installation failure caused by circumstances including:

  • incorrect measurements supplied by the customer;

  • unsuitable or improperly prepared walls or surfaces;

  • moisture, water intrusion, mold or structural conditions;

  • use of unsuitable adhesives, primers or installation materials;

  • incorrect cutting, trimming or panel alignment;

  • failure to follow installation instructions;

  • installer error or workmanship;

  • installation of a product after an apparent defect should reasonably have been identified.

Nothing in this section excludes rights that cannot lawfully be excluded under applicable consumer law.

SECTION 6 - PRICES, TAXES AND BILLING

Prices, discounts and promotions may change without notice.

The price applicable to your purchase will be the price shown when your order is placed, subject to correction of obvious errors.

Unless expressly stated otherwise, product prices may exclude shipping costs, customs duties, import taxes, VAT, brokerage fees or other government charges applicable in the destination country.

Where such charges are not collected by us at checkout, they may be assessed by customs authorities, carriers or other authorities upon import and are the responsibility of the recipient unless applicable law requires otherwise.

You agree to provide current, complete and accurate purchase, billing and account information.

You represent that you are authorized to use the payment method submitted for your purchase.

SECTION 7 - SHIPPING AND DELIVERY

We ship internationally to destinations made available during checkout.

Production times and delivery times shown on the website or communicated by us are estimates unless expressly stated otherwise.

Most international shipments arrive within the estimated delivery period described in our Shipping Policy, but customs processing, carrier disruptions, weather, local delivery conditions and other events outside our reasonable control may affect transit times.

We are not responsible for delays caused solely by carriers, customs authorities or circumstances outside our reasonable control, except where applicable law provides otherwise.

If we become aware that we cannot ship your order within a shipment period we have specifically promised, we may contact you with an updated estimated shipment date or provide other remedies required under applicable law.

For orders shipped to the United States, applicable consumer law may require us to obtain your consent to certain shipping delays or provide a refund if we cannot ship within a promised timeframe.

Risk of loss will pass in accordance with applicable law. Nothing in these Terms transfers risk to a consumer earlier than permitted by mandatory consumer protection law.

International customers are responsible for ensuring that products may lawfully be imported into their destination country and for paying applicable import duties or taxes not collected at checkout.

Please see our Shipping Policy for additional information.

SECTION 8 - DAMAGE IN TRANSIT AND PRODUCT ISSUES

If your order arrives visibly damaged, incomplete or appears materially different from what you ordered, please contact us as soon as reasonably possible.

We may request photographs of:

  • the product;

  • packaging;

  • shipping label;

  • damaged area;

  • the overall installation area where relevant.

These materials help us determine whether an issue arose during production, shipping or installation and may be necessary to submit a carrier claim.

Do not dispose of damaged packaging until we confirm that it is no longer required for a claim.

Where a product is defective, damaged or otherwise non-conforming, remedies will be provided in accordance with our Refund Policy and applicable law.

SECTION 9 - CUSTOMER-PROVIDED CONTENT

If you provide photographs, drawings, artwork, designs, logos, text, room photographs or other materials for customization or visualization, you represent that you own those materials or have all permissions necessary for us to use them for fulfilling your order.

You grant TAHHO a limited license to use such materials to communicate with you, prepare visualizations, manufacture your order and otherwise perform the Services you requested.

You are responsible for claims arising from materials you provide if you did not have the necessary rights to use them.

We will not publicly use customer-supplied room photographs or other private project materials for advertising without permission, except where otherwise permitted by our Privacy Policy or expressly agreed with you.

SECTION 10 - INTELLECTUAL PROPERTY

All original TAHHO designs, artwork, photographs, product imagery, graphics, text, branding, trademarks, videos and website content are owned by TAHHO or used under license and are protected by applicable intellectual property laws.

Purchasing a physical TAHHO product does not transfer copyright or other intellectual property rights in the underlying artwork or design.

You may not reproduce, manufacture, digitally copy, distribute, sell, license or commercially exploit TAHHO artwork or designs without our prior written permission.

Nothing in these Terms grants you ownership of TAHHO's intellectual property.

Customer reviews and other customer-created content remain subject to the rights of their respective creators, while any license granted to us under these Terms applies as described below.

SECTION 11 - OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to third-party tools, payment providers, shipping services or other services that we do not control.

Such services may be subject to separate terms and privacy policies of their respective providers.

To the maximum extent permitted by law, we are not responsible for acts or omissions of independent third-party service providers outside our reasonable control.

SECTION 12 - THIRD-PARTY LINKS

The Services may contain links to websites operated by third parties.

We are not responsible for the accuracy, content, practices or availability of third-party websites.

Your use of third-party websites is subject to their own terms and policies.

SECTION 13 - RELATIONSHIP WITH SHOPIFY

TAHHO is powered by Shopify, which enables us to provide the Services to you.

However, sales and purchases made through our store are transactions directly between you and TAHHO.

Shopify is not the seller of TAHHO products and, to the extent permitted by law, is not responsible for loss, damage or claims arising from products purchased from TAHHO.

SECTION 14 - PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our Services are hosted by Shopify, certain information may also be processed by Shopify and other service providers involved in operating the store, processing payments, preventing fraud, fulfilling orders and delivering Services.

Please review our Privacy Policy for more information.

SECTION 15 - REVIEWS, FEEDBACK AND SUBMISSIONS

If you submit a review, testimonial, photograph, suggestion or other content intended for publication or promotion, you grant TAHHO a non-exclusive, worldwide, royalty-free license to reproduce, publish, display and use that content in connection with our business and marketing, subject to applicable privacy and consumer protection laws.

You represent that you have the rights necessary to submit such content and that it does not infringe the rights of others.

Where we materially edit or translate a customer review, we will seek to preserve its original meaning.

SECTION 16 - ERRORS AND INACCURACIES

Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability.

We reserve the right to correct errors and update information where permitted by law.

If an error materially affects an order that has already been placed, we will contact you where required and provide any remedies required by applicable law.

SECTION 17 - PROHIBITED USES

You may use the Services only for lawful purposes.

You may not use the Services to:

  • violate applicable law;

  • infringe intellectual property or privacy rights;

  • transmit malware or malicious code;

  • engage in fraud or impersonation;

  • scrape, extract or systematically reproduce our content without permission;

  • interfere with the security or operation of the Services;

  • use TAHHO designs, artwork or imagery to create unauthorized commercial reproductions or derivative products.

We may suspend or terminate access to the Services where reasonably necessary to protect TAHHO, our customers or third parties.

SECTION 18 - TERMINATION

We may suspend or terminate access to the Services where permitted by law, including in response to fraud, misuse, security threats or violation of these Terms.

Termination does not affect rights and obligations arising before termination.

Sections intended by their nature to survive termination, including intellectual property, liability, indemnification and governing law provisions, will continue to apply.

SECTION 19 - DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Services are provided on an "as available" basis.

We do not guarantee that the website will always be uninterrupted, error-free or available.

Except for warranties expressly provided by TAHHO and rights or warranties that cannot lawfully be excluded, we disclaim implied warranties to the extent permitted by applicable law.

Nothing in these Terms excludes statutory guarantees, conformity rights or other mandatory consumer protections that apply to your purchase.

SECTION 20 - LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, TAHHO and its officers, employees, contractors and service providers will not be liable for indirect, incidental, special or consequential losses arising from use of the Services or products, including lost profits, lost revenue or business interruption.

Where liability cannot lawfully be excluded, our liability will be limited only to the extent permitted by applicable law.

TAHHO will not be responsible for losses caused by:

  • incorrect information or measurements supplied by the customer;

  • unauthorized modifications to the product;

  • incorrect installation;

  • unsuitable surfaces or environmental conditions;

  • failure to follow care or installation instructions;

  • ordinary handmade variation described in these Terms;

  • events outside our reasonable control.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

SECTION 21 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless TAHHO and its affiliates, employees, contractors and service providers from third-party claims arising from:

  1. your material breach of these Terms;

  2. your violation of applicable law or third-party rights; or

  3. customer-provided content for which you did not have sufficient rights or permissions.

SECTION 22 - EVENTS OUTSIDE OUR CONTROL

We will not be responsible for delay or failure to perform caused by events outside our reasonable control, including natural disasters, war, armed conflict, governmental restrictions, border closures, transportation disruptions, carrier interruptions, labor disputes, cyber incidents, power or telecommunications failures, shortages of materials or other comparable events.

Where such an event materially affects an order, we will take reasonable steps to communicate with you and comply with remedies required by applicable law.

SECTION 23 - SEVERABILITY

If any provision of these Terms is held unlawful, void or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain effective.

SECTION 24 - WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce a right under these Terms does not constitute a waiver of that right.

These Terms, together with the policies incorporated by reference and any custom order specifications expressly agreed between you and TAHHO, constitute the agreement governing your use of the Services and purchase of our products.

In the event of a conflict concerning a specific custom order, an expressly agreed written custom specification or quotation may take precedence over these general Terms for that order.

SECTION 25 - ASSIGNMENT

You may not assign your rights or obligations under these Terms without our prior written consent where such restriction is permitted by law.

We may assign or transfer our rights and obligations in connection with a sale, restructuring or transfer of our business, subject to applicable law.

SECTION 26 - GOVERNING LAW

These Terms and any contracts with TAHHO are governed by and construed in accordance with the laws of Ukraine, without prejudice to mandatory consumer protection rights that may apply to customers in their country of residence.

Any disputes will be subject to the jurisdiction of the courts competent under applicable law.

Nothing in this section deprives a consumer of protections or jurisdiction rights that cannot lawfully be waived.

SECTION 27 - CHANGES TO THESE TERMS

We may update these Terms from time to time.

The current version will be published on this page together with its effective date.

Changes will not retroactively alter contractual rights relating to an order already accepted unless permitted by law or agreed with the customer.

SECTION 28 - DISCLAIMER

Payments made through TAHHO are processed by Western Bid™, Inc., our Merchant of Record. Accordingly, WESTERN BID may appear as the payee on your credit card or PayPal statement.

SECTION 29 - CONTACT INFORMATION

Questions about these Terms or an order can be submitted through our Contact Us page.

Additional contact information may be provided where required by applicable law.

Please see our Privacy Policy, Refund Policy and Shipping Policy for additional information.
